Creator Agreement

About the Program

The SIMMY Creator Program lets you earn commission by promoting SIMMY persimmon soap to your audience. You'll get a unique referral link and promo code. When someone clicks your link and buys within 30 days, you earn a commission.

Eligibility

To join the SIMMY Creator Program, you must:

• Be at least 18 years old
• Be based in the United States
• Have an active social media presence (Instagram, TikTok, YouTube, a blog, or similar) with genuine, original content
• Agree to and follow these terms in full

SIMMY reserves the right to approve or deny applications at our discretion. We're looking for authentic creators, not spam accounts.

Commission Structure

Here's how you earn:

• Commission rate: $2.00 per bar sold through your referral link
• Buyer discount: Your promo code gives buyers 10% off their order — a genuine incentive to share
• Attribution window: 30 days from first click — if they buy within 30 days of clicking your link, it counts
• Tracking: via the simmy_ref cookie set on simmysoap.com (first-party, 30-day expiration)

Commission is calculated on the net sale price, excluding taxes and shipping.

Payments

• Commissions are paid monthly, typically within 15 days after the end of each calendar month
• Minimum payout threshold: $10.00 (earnings below this roll over to the next month)
• You are responsible for providing accurate payment information and keeping it updated
• If you earn $600 or more in a calendar year, SIMMY may be required to issue a Form 1099-NEC. You are responsible for reporting your earnings for tax purposes
• SIMMY is not responsible for payment delays caused by incorrect banking or payment information provided by you

FTC Disclosure Requirement — This Is Mandatory

When you promote SIMMY in exchange for commission, you must disclose the relationship clearly and conspicuously in every post, video, story, or content piece where you mention or promote SIMMY. This is required by the FTC.

• Use #ad or #sponsored — clearly visible, not buried in hashtags
• Disclosure must appear before any "click to expand" or "see more" truncation point
• Verbal disclosure is required in video content ("This video is sponsored by SIMMY" or "SIMMY sent me this soap and I earn a commission if you buy through my link")

Failing to disclose your relationship with SIMMY is a violation of FTC guidelines and this agreement, and may result in immediate termination from the program.

Content Standards

You may share your honest experience with SIMMY products. You may not:

• Make medical or drug claims: Do not claim SIMMY soap treats, cures, or prevents any disease or medical condition. It's a cosmetic product for odor control — say exactly that.
• Make misleading claims: Don't exaggerate results, fabricate reviews, or claim clinical efficacy beyond what SIMMY's own materials state
• Spam: No mass unsolicited messages, comment spam, or paid traffic schemes to inflate referral clicks
• Impersonate SIMMY: Don't create fake SIMMY accounts, websites, or suggest you are an official SIMMY representative
• Promote to minors: Do not target audiences under 18 with SIMMY promotions
• Violate platform rules: All content must comply with the terms of the platform you publish on

No Guarantee of Earnings

Participation in the SIMMY Creator Program does not guarantee any income. Commission earnings depend entirely on your audience's purchasing behavior. Past earnings by other creators are not representative of what you will earn. SIMMY makes no earnings representations or guarantees.

Independent Contractor Status

You are an independent contractor, not an employee, partner, or agent of SIMMY. You are solely responsible for your own taxes, expenses, and compliance with applicable laws. Nothing in this agreement creates an employment relationship.

Intellectual Property

SIMMY may provide you with product images, copy, and brand assets for promotional use. You may use these only for SIMMY promotion within this program. You may not modify SIMMY's logo or brand assets without written permission. SIMMY retains all ownership of its brand materials.

By submitting content (testimonials, photos, reviews) to SIMMY, you grant SIMMY a non-exclusive, royalty-free license to use that content for marketing purposes.

Termination

Either party may end this agreement at any time:

• You may leave the program by emailing hello@simmysoap.com. Earned, unpaid commissions will be paid out in the next payment cycle.
• SIMMY may terminate your account immediately for violations of these terms, FTC non-compliance, fraud, or conduct that SIMMY reasonably determines is harmful to the brand or program
• SIMMY may also discontinue or change the Creator Program at any time with 30 days' notice to active creators

Upon termination, your referral link and promo code will be deactivated. Any commissions earned before termination will be paid, subject to a fraud review period.

Limitation of Liability

SIMMY's total liability to any creator under this agreement shall not exceed the total commissions paid to that creator in the 6 months preceding the claim. SIMMY is not liable for indirect, incidental, or consequential damages of any kind.

Governing Law

This agreement is governed by the laws of the State of California. Any disputes shall be resolved in California courts. If any provision of this agreement is found unenforceable, the remainder stays in effect.

Changes to This Agreement

We may update these terms as the program grows. We'll notify active creators by email at least 14 days before changes take effect. Continuing to participate after the effective date constitutes acceptance.
